ELITE UK HOMES

Buyer & Tenant Terms

These terms apply when you browse property listings, contact us about a property or request a viewing through ELITE UK HOMES. They explain the general arrangements for prospective buyers and tenants.

Please read these terms before submitting a property enquiry or viewing request. They explain how enquiries and viewings are handled and what to expect during the initial stages of a potential property transaction.

These terms do not constitute a property purchase contract, tenancy agreement, reservation agreement, mortgage offer or guarantee that a property will remain available.

Nothing in these terms limits any statutory right you have under applicable law.

1. About Us

ELITE UK HOMES is the trading name of ELITE UK INVESTMENTS LTD, a company registered in England and Wales.

In these terms, “we”, “us” and “our” refer to ELITE UK INVESTMENTS LTD trading as ELITE UK HOMES. “You” refers to a prospective buyer, prospective tenant or other person making an enquiry about a property.

2. Scope of These Terms

These terms apply to your use of our property enquiry and viewing services, including:

  • Browsing properties advertised for sale or rent.
  • Requesting further information about a property.
  • Submitting an enquiry through our website or by email or telephone.
  • Requesting or arranging a property viewing.
  • Communicating with us about a possible purchase or tenancy.

Additional documents or agreements may apply if you decide to proceed with a purchase or tenancy. The relevant transaction documents will set out the terms applicable to that transaction.

3. Property Listings and Availability

We aim to present property information clearly and accurately based on the information available to us. Property listings may include descriptions, photographs, floor plans, measurements, asking prices, rental figures and other details.

Property information may be supplied by the owner or obtained from other sources. Although we take reasonable care in handling and presenting this information, details may change and errors may occasionally occur.

A property listing is an invitation to make an enquiry. It is not a guarantee that the property is still available, that an offer will be accepted or that a tenancy or sale will proceed.

Availability, prices, viewing arrangements and other details should be confirmed with us before you make decisions or incur costs in connection with a property.

If you notice information that appears incorrect, please contact us so that we can review it.

4. Enquiries and Viewing Requests

You may contact us through the website enquiry form, by email or by telephone to ask about a property or request a viewing.

Submitting an enquiry or viewing request does not automatically confirm an appointment. We may need to contact you to clarify your request, confirm availability or agree a suitable time.

A viewing is confirmed only when the arrangements have been agreed with you. We may need to change or cancel an appointment if circumstances change, including where the owner or current occupier is unable to provide access.

If you need to cancel or change an appointment, please notify us as soon as reasonably possible so that alternative arrangements can be considered.

We do not charge a viewing fee for enquiries or viewings arranged through our standard services.

5. Conduct During Viewings

When attending a viewing, you agree to:

  • Arrive at the agreed time or tell us if you are delayed.
  • Follow reasonable instructions from the person conducting the viewing.
  • Respect the property, its contents, the owner and any occupiers.
  • Not enter areas that have not been made available for viewing.
  • Not photograph, record or share private areas or personal belongings without permission.
  • Not interfere with fixtures, fittings, security systems or personal possessions.
  • Raise any safety concerns with the person conducting the viewing.

We may end a viewing if a person's conduct creates a safety concern, causes damage or seriously interferes with the rights of the owner or occupier.

These terms do not exclude or limit any legal responsibility we may have for our own acts or omissions.

6. Terms for Prospective Buyers

6.1 Offers

If you wish to make an offer on a property, please contact us and provide the information reasonably needed to communicate your offer to the owner.

We will handle and communicate offers in accordance with our legal obligations and the arrangements applicable to the property. The owner decides whether to accept, reject or negotiate an offer, subject to applicable law.

6.2 No Guarantee of Acceptance

Making an offer does not guarantee acceptance or prevent the owner from considering other offers, subject to any binding agreement or applicable legal obligations.

6.3 Sale Process

In England, a residential property sale generally becomes legally binding when contracts are exchanged. Before that stage, either party may generally withdraw, subject to any separate binding agreement or applicable law.

If you wish to proceed, you should obtain independent legal advice and consider arranging a survey, checking title and planning information, and confirming your mortgage or funding arrangements.

We do not provide conveyancing, surveying, mortgage advice or legal advice unless a separate service is expressly agreed and lawfully provided.

6.4 Payments

Any deposit, purchase money or other amount payable in connection with a purchase must be dealt with in accordance with the relevant transaction documents and instructions from the authorised recipient, such as your solicitor or conveyancer.

Under our standard services, ELITE UK HOMES does not collect property sale proceeds on behalf of the owner.

7. Terms for Prospective Tenants

7.1 Rental Enquiries

You may contact us to ask about a rental property, its availability, the proposed rent, viewing arrangements or the next steps in the letting process.

An enquiry or viewing does not guarantee that a property will be offered to you or reserved for you.

7.2 Applications and Information

If you wish to proceed after viewing a property, we may explain the next steps and request information reasonably needed for the proposed letting, subject to applicable law.

You must provide information that is accurate and complete to the best of your knowledge. You should not provide another person's information without proper authority.

Any referencing, affordability assessment, right to rent check or other verification will be carried out only where applicable and in accordance with the relevant legal requirements and privacy information.

7.3 Tenancy Agreement

A tenancy will be subject to the tenancy agreement and applicable housing law. Before agreeing to rent a property, you should read the tenancy terms, confirm the rent and payment schedule, and understand your obligations as a tenant.

A viewing, application or informal discussion does not itself create a tenancy agreement.

7.4 Tenant Fees and Payments

We will not charge fees prohibited by the Tenant Fees Act 2019 or other applicable law. Any payment requested from you must be lawful, properly explained and applicable to the proposed transaction.

Under our standard services, ELITE UK HOMES does not collect rent or tenancy deposits on behalf of the property owner. Payment arrangements will be explained through the relevant letting process and tenancy documentation.

7.5 Your Legal Rights

Nothing in these terms removes your statutory rights as a prospective tenant or tenant. The rights and obligations applying to a tenancy will depend on the property, the tenancy agreement and the law in force at the relevant time.

8. No Reservation or Transaction Guarantee

Unless a separate written agreement expressly states otherwise, we do not reserve a property for you merely because you have made an enquiry, attended a viewing or submitted an offer or application.

We cannot guarantee that an owner will accept an offer, select a particular applicant, withdraw a listing or proceed with a proposed transaction.

We also cannot guarantee that another party will meet its obligations or that a proposed transaction will complete. This does not affect any responsibility we have under applicable law.

9. Information You Provide

When you contact us, you should provide information that is accurate, relevant and up to date. This may include your contact details, the property you are interested in and information needed to respond to your enquiry.

You must not use another person's identity or submit information that is knowingly false, misleading or unauthorised.

We may be unable to respond fully to an enquiry if the information supplied is incomplete or if we cannot reasonably verify the details needed for the requested service.

10. Privacy and Personal Information

We use personal information to respond to enquiries, arrange viewings, communicate about properties and administer the services you request.

Our Privacy Policy explains how we collect, use, store and share personal information, the lawful bases we rely on where required, and the rights available to individuals under applicable data protection law.

You can contact us at consult@eliteukhomes.org if you have a question about the handling of your personal information.

11. Website and Third-Party Information

Our website may contain links to external websites or resources operated by other organisations. These links are provided for convenience and information.

We do not control external websites and are not responsible for their content, availability, policies or services. You should review the terms and privacy information published by those providers before using their services.

Nothing in this section excludes liability where doing so would be unlawful.

12. Liability and Legal Rights

We will exercise reasonable care when handling enquiries and arranging viewings within the scope of our services. However, we cannot guarantee that property information will remain unchanged or that another party will proceed with a transaction.

Nothing in these terms excludes or limits liability for fraud, fraudulent misrepresentation, death or personal injury caused by negligence, or any other liability that cannot lawfully be excluded or limited.

If you are acting as a consumer, nothing in these terms affects your statutory rights under applicable consumer protection law.

13. Changes to These Terms

We may update these terms when necessary to reflect changes to our services, website or applicable legal requirements.

The version applicable to a particular interaction will be determined by the circumstances and applicable law. An update to these terms will not retrospectively remove a right that has already arisen.

14. Governing Law

These terms are governed by the law of England and Wales, subject to any mandatory legal protections that apply to you.

Nothing in this section deprives a consumer of any mandatory rights or court protections that cannot lawfully be excluded by agreement.
